GREETINGS AND SALUTATIONS, MY FRIENDS AND SUPPORTERS AND HOPEFULLY, "SOON-TO-BE NEW FRIENDS.”

At long last, the state of Idaho has filed their final appeal, to the U.S. Supreme Court. It is a sad, unpersuasive attempt to have the Decision of the 9th Circuit Court reversed; I suppose to have a conviction/sentence reinstated and I be rushed to my death by lethal injection, such insane, demonic bloodlust!

Our reply is due by August and we anticipate "Scotus” will deny Idaho's request. In the first week of October, after their summer recess, they could accept the case, which would mean my attorney would have to go to Washington, D.C., to argue my position and a decision would be made before June, 2008. Let's pray it's denied and I'm released.

How am I doing through all this? Very well, considering it's been almost 24 years. It's been almost all solitary confinement, it's been over 100 degrees for several days and a man with mental issues/sexual identity issues lives right above me. For a minute there, I thought I was at the beach! (Maybe next summer!)

I wish to extend my heartfelt thanks to everyone: for the love, friendship, fellowship and support in these years of my deepest distress.

The letters, petitions, phone calls and prayers in my behalf have been fantastic testament to compassion and the desire to allow truth to prevail. Without you, this would be a lonely, almost-not-worth-fighting battle at times, even when you're 100% right, you believe you're the only one that truly understands. Lucky for me, you have not abandoned me, which says a great deal about you! You're fantastic! If I ever offended anyone, for I can sometimes get a bit "out there”, please accept my humble apology.

Having said that, I shall now turn my attention to Idaho's position in this latest petition and yes, I'm blasting it! They seem to be "chicken Little”, yelling to the court, "The sky is falling, the sky is falling!” Well, this position is wrong and it sux!! Seriously, it's not an impressive attempt.

Idaho posits that the decision to vacate my conviction (a conviction which was/is illegal under Idaho law and the U.S./Idaho Constitutions) is in error and should be reversed.

My attorney not knowing the law, thereby allowing me to be convicted on my brother's uncorroborated testimony, without any evidence, which is illegal in Idaho, should not matter in their opinion. Idaho says they could convict me anyway, without my brother's lies, under Idaho's "Felony Murder” rule.

This means that anyone involved in a felony wherein someone is murdered, is also held responsible for the murder whether they were the "actual killer” or not. Under this theory (and it's only Idaho's little unproven theory), Idaho says they only must prove that I was involved in a robbery to convince me. They further state they "sufficiently proved” that I was a participant in a robbery, which is another lie. How do they do this? Quite simply, they don't! It's sort of like Rumsfeld speaking about "No weapons of mass destruction” being found in Iraq after the U.S. invasion. He said, "Absence of evidence is not evidence of absence!”

Idaho simply stating their opinion does not make evidence. Of course, with their "God Complex”, one would wonder if they care about actual truth. I was originally charged with robbery, but the Idaho County Magistrate threw the charge out, due to "insufficient evidence”! The meat of the issue is that the murders of Mr. and Mrs. Bravence can't be separated from the robbery of them. This has been confessed to by another person, numerous times and in open court. The testimony relied upon to connect me to the robbery is the same uncorroborated, illegal testimony*

No circular logic by Idaho will be able to overcome my illegal conviction. All Idaho can offer is unsubstantiated opinion, with no evidential underpinning. They aver that my fingerprints found in a van weeks later, proves robbery. This is laughable! Do they have a psychic at the attorney General's office? There were "no witnesses, no weapon, no forensic evidence, no circumstantial evidence” saying I perpetrated these crimes, as determined by the court. So, upon what is Idaho's opinion based? Nothing, only Bryan's illegal words and pure surmise.

Only Bryan's words, which he has recanted and he maintains was coerced from him under threat of death. There is not one iota of evidence, to any degree, none that can show I ever saw Mr. and Mrs. Bravence alive. Why: Because I didn't! Only upon Bryan's illegal testimony, as the court wisely ruled on this, "A conviction cannot be had” under Idaho law. It's really simple, not complex and world changing, as Idaho would have the court believe. Remember, Idaho made this same lame argument when they tried to get the 9th Circuit to rehear my opinion. Not one judge voted to reconsider, not even the two Idaho Judges!

You cannot convict anyone of anything, much less murder them by Idaho's satanic chemical cocktail (lethal injection), based on the bare, bald word of one person and you should not be able to do so. The incentive to lie, for self-preservation is too great, especially when all the evidence points to the one upon who's word you're relying and using against another, upon which no evidence exists!

All should remember this truth: I am innocent and always have been! We will soon know, as the clock is ticking on Idaho's accountability in the crimes against me. They protesteth too much, I say. In the interim, I am doing all I can to fight Idaho's lies, even though the Idaho media seems to believe everything Idaho makes up. Without any investigation, they can't even get the prosecutor's name right.

The prosecutor, Kirk MacGregor (not McDonald), spoke to the media and seems to disagree with the "gods” at the Attorney General's office. He said, about retrying me, "Because if you don't have the evidence, it doesn't do you any good to proceed.” This tells the tale, for he knows they have no evidence and I'm innocent. Will he say this? No way!

Now, my brother has filed a "Motion for New Trial” in Federal Court, based on actual evidence of the judge being corrupt and our trials unfair. Jerry Pizzuto also as such an Appeal pending, with the same judge, same issue. I am also filing a "Motion for New Trial” in Idaho District Court, based upon the actions of this criminal masquerading as a judge. Idaho is "panic-stricken” over this, afraid that all the judge has done will come out in public. It needs to be public, for who knows how many people are unjustly incarcerated due to this judge's criminal acts? He's been doing it since 1983, nearly a quarter-century of "cover-up”!

Idaho County Commissioner Randy Doman, a man of dubious intellect, made some thinly-veiled "death threats” against me in the media, saying some locals wanted to "take care of me”. Since Idaho County is where any new trial would be held, the trial would have to be moved elsewhere because of this, but Idaho County must still pay for it! All they seem to be really concerned about is how much it would cost. No wonder they offered me a "deal” in mediation. They could easily bankrupt the county and lose, too! Amazingly shortsighted and stupid!

They cry about the cost like petulant schoolgirls. If they had not illegally convicted me and violated all my constitutional rights, which they hold dear for themselves, we wouldn't be going through this "passion play.”

About the death threats: I won't dignify such cowardly tripe with a response. Such hatefulness seems to be common up there and it sounds like a lot of murderous types are running around in Idaho County. As one former attorney said: "Must be the inbreeding.”

So, stay strong and write me. I hope to see everyone soon! I still need your help. But we won! We won from the start!
